Terms Of Use

These terms of use apply to the website https://bookerty.com, https://bookerty.gr, applications, and all other offerings from Bookerty (hereinafter collectively the “Bookerty Platform”). The Bookerty Platform is owned and managed by the corporation “BOOKERTY” (hereinafter “Bookerty”).

The access to and use of the Bookerty Platform is governed by these terms of use (hereinafter the “Terms of Use”).

Before using the Bookerty Platform, please ensure that you have carefully read and understood the Terms of Use. Your access to or use of the Bookerty Platform constitutes your unreserved acceptance of and binding to the Terms of Use. In case you do not agree with the Terms of Use, your access to and use of the Bookerty Platform is not permitted.

The access to and use of the Bookerty Platform shall be in compliance with the Terms of Use and the laws, as in force.

Bookerty Platform

The Bookerty Platform constitutes a digital environment wherein natural or legal persons (hereinafter individually referred to as a “Member” and collectively as the “Members”) may, at their own discretion, either publish and display listings relating to accommodation offerings (hereinafter individually referred to as “Listing” and collectively as “Listings”), along with optional contact information (such Members hereinafter referred to as the “Hosts”), or browse such listings in search of temporary accommodation or related services (such Members hereinafter referred to as the “Guests”).

The listings published by Hosts may include the provision of temporary lodging, hotel accomodations, holiday rentals, or similar property-based arrangements (hereinafter individually referred to as an “Accommodation” and collectively as the “Accommodations”).

Bookerty provides the technological infrastructure enabling the publication and discovery of such listings. Bookerty does not participate in, and disclaims all liability for, the formation or execution of any agreements or transactions between Hosts and Guests, which shall occur entirely outside the scope of the Platform and at the sole discretion and risk of the respective parties.

Member Account

In order to access and use the Bookerty Platform, you shall register an account. Only natural persons who have attained the age of eighteen (18) years and legal entities are permitted to register an account. You warrant that you or the entity you legally represent have the legal capacity and authority to use the Bookerty Platform, according to the laws of the country of your residence, establishment, or other applicable jurisdiction.

You are responsible for keeping your credentials confidential, which you may not disclose to any third party. In case of loss of your credentials or unauthorized use of your account or if your account is otherwise compromised, you shall immediately notify Bookerty. You are liable for any activity conducted through your Bookerty account, unless such activity is not authorized by you and you are not otherwise negligent.

If and as permitted by applicable law, Bookerty may, but has no obligation to, ask you to provide identification or other information, undertake checks for the verification of your identity or background, screen you against third-party databases or other sources, and request reports from service providers and obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

Hosts Terms

Platform Use

Bookerty provides the Bookerty Platform and tools for registering the listings terms therein (hereinafter each the “Registration” and collectively the “Registrations”), as specified below, and managing your Registrations.

You can use the Bookerty Platform to publish listings of your accomodation/accomodations and/or hotel/hotels, registering in the Bookerty Platform information about your Registration, such as display of your contact information, description, photos, price, including any applicable taxes, other charges (e.g., cleaning fees), the requirements, and the rules that apply to your Registration or Guests (hereinafter each the “Listings Terms” and collectively the “Listings Terms”).

You may register only once for each Accommodation, but in case an Accommodation has multiple places to stay, you may have multiple Registrations.

For the purposes of these Terms of Use, the term “Registration” shall denote the structured set of data and conditions input by the Host into the Bookerty Platform, encompassing details such as pricing, availability, stay requirements, and other relevant parameters. The term “Listing” refers to the externalized representation of such Registration, as rendered and made accessible to Guests via the Platform’s public interface and search functionalities.

Agreement with Bookerty

By registering on the Bookerty Platform as a Member, you hereby enter into a non-exclusive agreement with Bookerty for the use of the Platform and its associated functionalities. This agreement grants you access to the Platform's digital environment, as further described in the Platform Use section herein, subject to the terms and conditions set forth in this document.

Legal Obligations

Hosts expressly acknowledge and agree that Bookerty functions solely as a digital environment for the publication of Listings and the display of contact information, and does not act as a booking intermediary, payment processor, or contracting agent. Bookerty does not participate in, monitor, or assume any responsibility for interactions, agreements, or transactions that may arise between a Host and a Guest outside the Platform.

Accordingly, the Host bears sole and exclusive responsibility for any engagement conducted beyond the boundaries of the Platform, including but not limited to verbal or written agreements, disclosure of personal or property details, coordination of services, and receipt of payments. The Host assumes full liability for the accuracy, legality, and enforceability of any such engagement.

Bookerty shall not be held liable for any damages, losses, claims, or disputes arising from off-platform conduct, and such interactions shall be deemed to occur entirely at the Host’s own initiative and risk.

Disclaimer

It is expressly clarified herein that you are acting as an independent natural or legal person/entity, and nothing contained herein shall be construed as creating an employment relationship, partnership, agency, or joint venture between you and Bookerty. Bookerty acts solely as a free accommodations listing facilitator. Bookerty does not direct or control the manner, terms, or execution of your services outside the Platform. You retain full and exclusive discretion to determine the terms of your services and to enter into agreements with Guests outside the Platform. Bookerty bears no responsibility for any agreements, payments, disputes, or damages arising from communications or transactions conducted outside the Bookerty Platform. Such interactions shall be undertaken entirely at your own risk.

Guest Terms

Platform Use

Guests may navigate the Platform and conduct searches for Listings by applying various criteria and filters, as outlined in the section entitled Search Results Factors. Upon identifying a Listing of interest, Guests may initiate direct communication with the respective Host, subject to the Host’s availability and discretion.

Agreement with Bookerty

By registering on the Bookerty Platform as a Member, you thereby enter into a legal agreement with Bookerty. This agreement grants you access to the Platform and its functionalities, solely for the purpose of exploring Listings and initiating contact with Hosts, as further detailed in the section titled Platform Use. Bookerty does not participate in, mediate, or assume responsibility for any agreements or transactions conducted outside the Platform.

Legal Obligations

Guests acknowledge and agree that Bookerty acts solely as a provider of a digital environment for the publication and discovery of accommodation Listings and does not function as an intermediary, agent, or facilitator of bookings. Bookerty does not participate in or assume any responsibility for the communication, negotiation, agreement, or transaction that may ensue between a Guest and a Host beyond the confines of the Platform.

Accordingly, the Guest shall bear full legal and financial responsibility for any actions undertaken outside the Platform in connection with a Listing. This includes, but is not limited to, making verbal or written agreements, exchanging personal contact details, arranging payments, modifying or cancelling agreements, and addressing any disputes arising from such interactions.

Bookerty disclaims any and all liability for losses, damages, or claims resulting from off-platform conduct, and any such engagement shall be deemed to occur entirely at the Guest’s own risk and discretion.

Bookerty does not facilitate, process, or intermediate any transactions, bookings, or contractual agreements between Hosts and Guests. Any communication, negotiation, or agreement between Members occurs solely outside the scope of the Platform. Consequently, the provisions of Directive 2011/83/EU on consumer rights, including the 14-day right of withdrawal for distance contracts, are not applicable to any activity undertaken through the Bookerty Platform. Any consumer rights relating to services or cancellations shall be addressed directly between the respective Host and Guest.

Content

Any information and/or data registered in the Bookerty Platform (hereinafter the “Content”) must be accurate and not contain any inappropriate, including misleading, offensive and discrimination, comments and may not violate applicable laws.

Complaints

Bookerty operates as a free online platform enabling the display of accommodation listings and the exchange of contact information between Users. While Bookerty does not moderate transactions or verify content, it maintains the right to take reasonable action in response to reports concerning potentially illegal or harmful material.

Should you identify content on the Bookerty Platform that you reasonably believe to be unlawful or contrary to these Terms of Use, you may submit a complaint using the designated electronic notification form (“Notification Form”). Bookerty shall assess such notifications in good faith and may, at its sole discretion, take one or more of the following actions:

Restrict the visibility of, or remove, the reported content.
Temporarily or permanently disable the User account responsible for the content, in cases of repeated or serious violations.

Bookerty is not under any legal obligation to review all user-generated content and assumes no liability for any failure to detect or remove allegedly unlawful material unless otherwise required by applicable law.

Bookerty may also employ automated or manual review processes, as appropriate, and shall inform the Member where action has been taken following the use of such processes, unless this would conflict with Bookerty’s legitimate interests or applicable legal constraints.

Reporting

Should you become aware of content or conduct on the Bookerty Platform that you reasonably believe may violate applicable laws, infringe upon the rights of others, or pose a threat to public safety, you are strongly encouraged to immediately notify the appropriate local authorities. Thereafter, you may report the incident to Bookerty by submitting a copy of the report filed with the relevant authorities, upon Bookerty’s request. Bookerty is not legally obligated to intervene or take any specific action unless such obligation arises under applicable law.

Violations

Bookerty does not monitor or mediate interactions, transactions, or agreements between Users. Nevertheless, Bookerty reserves the right to take appropriate action in the event of:

Breach of these Terms of Use.
Violation of applicable laws or third-party rights through use of the Platform.
Submission of unlawful, misleading, defamatory, or otherwise harmful content incompatible with the Platform’s purpose.
Repeated receipt of substantiated complaints or negative reports regarding a Member’s conduct on the Platform.
Misuse of the Platform in a manner that may compromise the security, integrity, or lawful purpose of the service.

In such cases, Bookerty may, at its sole discretion:

Temporarily or permanently suspend or restrict access to the Platform.
Remove or restrict the visibility of Listings, reviews, or other user-submitted content.
Revoke any special status or visibility preferences associated with a Member’s profile or Listing.

In cases of non-material breaches or minor violations, and where appropriate, Bookerty may issue a notice granting the Member an opportunity to resolve the matter. Such notice may be withheld where its issuance would impede the detection or prevention of unlawful activity, threaten the safety of individuals, or contravene legal obligations.

Bookerty shall, where required by applicable law, provide the affected Member with a statement of reasons for any measure taken under this section.

Term – Termination

Term

The agreement between you and Bookerty remains in effect until any of the parties terminates the agreement in accordance with the Terms of Use.

Termination

You may terminate the agreement between you and Bookerty at any time by sending an email or by deleting your account.

Bookerty may terminate the agreement between you and Bookerty for any reason by providing 30 days’ notice before the termination effects become effective, via email or without prior notice in case of:

Material breach of the Terms of Use or Bookerty’s policies.
Violation of applicable laws or regulations.
Infringement of any rights of Bookerty, the Members, or third parties, in which cases the termination effects become effective immediately.

Termination Effects

In the event of termination of the agreement between a Host and Bookerty, any active or inactive Listings associated with the Host shall be removed from public visibility on the Platform.

In all cases where a User’s access to the Bookerty Platform has been limited or disabled, or where the agreement with Bookerty has been terminated, such User shall not create a new account or otherwise access or use the Platform, directly or indirectly, without the express prior written consent of Bookerty.

Miscallaneous Provisions

Search Results Factors

Search results are based on relevance with the search criteria/filters, which (the relevance) is determined by factors, including, but not limited to the following:

Guest search parameters, such as travel destination, travel dates, number of guests, price, etc.
Registration characteristics, such as calendar availability, Accommodation location, price, reviews, popularity, etc.
Registration requirements, e.g., minimum or maximum booking dates, etc.

Technical Measures

You are prohibited from using any tools to access, collect data, or interact with the Bookerty Platform, take any action that could affect the functional settings of the Bookerty Platform, such as manipulating the search algorithm, etc., and in general engage in any practices that could affect the security measures protecting the Bookerty Platform or its Content or harm the functionality of the Bookerty Platform.

Bookerty warrants that it takes all reasonable technical measures to ensure the secure use and proper function of the Bookerty Platform. However, Bookerty is not responsible for any damage or technical malfunction occurring on the Bookerty Platform, resulting in the temporary or permanent interruption of the Bookerty Platform use, such as the non-registration of some entries, due to Internet and telecommunications infrastructure disruptions.

Further, Bookerty does not warrant that the servers through which the Bookerty Platform is made available to the Members are provided without harmful software or that the services, options or results thereof are correct, complete, and available at all times. It is the sole responsibility of each Member to ensure, by using anti-virus software, that their personal computer and files are not compromised and protected from harmful/malicious software, such as viruses or malicious programs - applications, as well as the eventual combating of any such detected software.

In any case, Bookerty shall not bear any responsibility and/or expense for the necessary maintenance or repair of the Member’s computer and in general its system for any damage suffered following its visit to the Bookerty Platform, as well as for any other damage from this cause and for any reason and cause.

Bookerty may, temporarily and under consideration of the Members’ legitimate interests (e.g., by providing prior notice), restrict the availability of the Bookerty Platform or certain features thereof, if this is necessary in view of capacity limits, the security or integrity of Bookerty’s servers or to carry out maintenance measures that ensure the proper or improved functioning of the Bookerty Platform.

Links

Links to the Bookerty Platform are prohibited without the prior written consent of Bookerty.

The Bookerty Platform may contain links to other websites (hereinafter the “Links”). Bookerty bears no responsibility for the availability of the Links, their security, or their content. Bookerty suggests that you carefully read the terms of use and the privacy and cookies policy of these Links before using them.

Copyright

By registering any information and/or data in the Bookerty Platform, you grant Bookerty the sub-licensable license to use, copy, modify, prepare derivative works of, reproduce, publish or distribute such content. You warrant that you own the information and/or data registered in the Bookerty Platform or that you are authorized to grant Bookerty the above-mentioned rights, and you are liable in case any of the content registered in the Bookerty Platform by you infringes any third party’s intellectual property or privacy rights.

The Bookerty Platform and the Bookerty content are the intellectual property of Bookerty and/or its licensors and are protected by the provisions of national and international law governing intellectual property.

The Content of the Bookerty Platform is provided solely for your information and personal, non-commercial use and you may use it only to the extent necessary to use the Bookerty Platform as a Host or a Guest. Any other use of the Bookerty Platform or its content is prohibited. You may not copy, modify, prepare derivative works of, reproduce, publish or distribute and in any way exploit any content of the Bookerty Platform, except to the extent you are the legal owner of the content, you have the written permission of the legal owner or as expressly permitted in the Terms of Use.

Content

Bookerty is not responsible for the accuracy, completeness, and validity of the Content, which shall be legal and compatible with the Terms of Use. The Content is not verified by Bookerty, however, Bookerty reserves the right to undertake investigations to detect and disable access to illegal or incompatible Content and to take any required measures according to the laws and the Terms of Use, and you agree to cooperate with Bookerty in any reasonable way with respect to the above-mentioned purposes.

You acknowledge that Bookerty may use, for your convenience, services or automated tools to translate the Content and is not responsible for the accuracy of such translation. Bookerty suggests that you always check the quality of the translations of the original wording of any Content.

Bookerty’s Role

Bookerty does not own, control, offer, manage, or intermediate any Reservations (which refers solely to agreements made outside the Platform by the parties involved), Host Services, or tourism-related services. Bookerty is not a party to any agreement entered into directly between Hosts and Guests, nor does it act as a real estate broker, travel agent, insurer, or as an organiser or retailer of travel packages within the meaning of Directive (EU) 2015/2302.

Bookerty merely provides a digital platform that enables the publication of accommodation Listings and facilitates direct communication between Hosts and Guests. Bookerty does not participate in, supervise, or bear any responsibility for the negotiation, formation, or execution of any arrangement concluded outside the Platform. Bookerty does not act as an agent, representative, or intermediary of any Member for any purpose whatsoever.

General Rules

In case you provide Bookerty with someone else’s personal information, you:

Shall do so in compliance with applicable law.
Shall be authorized to do so.
Authorize Bookerty to process that information under Bookerty’s Privacy Policy.

The Bookerty Platform, the messaging tools or Member’s personal information shall not be used for sending commercial messages, without their express consent.

Hosts shall not solicit Guests to take actions that contravene the Terms of Use, including but not limited to the creation of third-party accounts or submission of reviews unrelated to the specific accommodation experience, unless expressly permitted herein.

Any terms, conditions, or obligations that a Host wishes to include in a supplemental agreement with a Guest must:

Be consistent with the Terms of Use of the Bookerty Platform and aligned with the information publicly provided in the relevant Listing (hereinafter the "Registration").
Be clearly and conspicuously disclosed within the Registration description, unless such disclosure is exempted under the present Terms, including in cases where the Host has opted to make contact information available in accordance with the Platform’s functionality.

As Bookerty does not facilitate payments, Hosts are solely responsible for determining, communicating, and collecting any fees or charges associated with a possible stay. Bookerty bears no liability for any such financial arrangements made outside the Platform.

Legal Obligations

Bookerty may take any actions reasonably necessary to:

Comply with applicable law or any order or request issued by a competent court, law enforcement authority, regulatory or administrative body, including the measures described in the Terms of Use.
Preserve the integrity, security and lawful operation of the Bookerty Platform.
Ensure that Members comply with the Terms of Use and act in accordance with the permitted use of the Platform as set forth herein.
Address Content or conduct that is deemed harmful, unlawful, misleading, or otherwise inconsistent with the nature and community principles of the Bookerty Platform.

Force Majeure

Bookerty shall bear no liability and shall not be deemed in breach of its obligations under the present Terms of Use for any failure or delay in the performance thereof, where such failure or delay arises from causes beyond its reasonable control. Such causes shall include, without limitation, acts of God, natural disasters, fire, flood, earthquake, explosion, war, armed conflict, acts of terrorism, rebellion, riot, insurrection, civil commotion, embargoes, blockades, pandemics, epidemics, public health emergencies, strikes, lockouts or other labor disturbances, interruptions in transportation or communications, shortages in energy supply or raw materials, governmental orders, regulatory restrictions, or the failure of any third party to perform any commitment related to the operation of the Bookerty Platform.

In any such event, Bookerty shall be entitled to suspend its obligations for the duration of the Force Majeure event, without incurring any liability towards Members or third parties.

Disclaimer

Bookerty endeavors to provide Members with a reliable and user-friendly digital environment. However, Bookerty neither controls nor assumes responsibility for the conduct, actions, omissions, or performance of Hosts, Guests, or any third parties. Accordingly, Bookerty makes no representations or warranties, express or implied, regarding the existence, availability, suitability, quality, safety, legality, or accuracy of any Listings, services, or Content displayed on the Bookerty Platform, including but not limited to reviews or other information submitted by Members.

Bookerty does not warrant that any identity verification, background screening, or similar due diligence conducted by or on behalf of Bookerty will be exhaustive or conclusive, nor that such measures will detect prior misconduct or prevent future incidents. Any reference on the Platform to a Member being "verified" or similar terminology shall be understood solely as confirmation that a limited verification process has been completed and shall not constitute any endorsement, guarantee, or certification by Bookerty.

To the extent that contact information of a Host is made available to a Guest pursuant to the Terms of Use, Bookerty disclaims any and all liability arising out of or related to the negotiation, formation, content, or execution of any agreement entered into between the Host and the Guest, whether verbal or written, including any preparatory interactions, such as communications or exchanges of information. Any such engagement occurs entirely at the discretion and risk of the parties involved.

Indemnification

To the fullest extent permitted under applicable law, you hereby irrevocably agree to indemnify, defend (at Bookerty’s sole discretion), and hold harmless BOOKERTY, its affiliates, officers, directors, employees, representatives, successors and assigns from and against any and all claims, actions, proceedings, investigations, liabilities, losses, damages, penalties, interest, costs or expenses (including, without limitation, reasonable legal and accounting fees) arising out of or in connection with:

any actual or alleged breach by you of the present Terms of Use or any other binding agreement entered into with Bookerty;
any violation by you of applicable law, regulation, administrative order or the rights of any third party, including but not limited to intellectual property rights, privacy rights, and contractual rights;
any failure on your part to fulfil legal obligations, including without limitation obligations relating to tax reporting, anti-money laundering, or consumer protection;
any misuse, unauthorized use, or fraudulent activity conducted by you or through your account on the Bookerty Platform;
any interaction, communication, agreement, or transaction between you and any other Member of the Platform, including but not limited to any stay at an accommodation, the provision or receipt of any services, or participation in any offering, and any damages, injuries, losses (whether direct, indirect, incidental or consequential) or disputes arising therefrom.

The foregoing indemnity shall remain in full force and effect notwithstanding the expiration or termination of these Terms or your use of the Bookerty Platform, and shall survive as a continuing obligation for so long as any such claims or liabilities may be asserted.

No Waiver

No failure or delay by Bookerty in exercising any right, power, or remedy under these Terms of Use shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any other or further exercise of the same or of any other right, power, or remedy. No waiver shall be effective unless made in writing and signed by an authorized representative of Bookerty. Except as expressly provided herein, the rights and remedies provided to Bookerty are cumulative and not exclusive of any rights or remedies provided by law or in equity.

Assignment

Bookerty may assign or transfer its rights and obligations under these Terms of Use, in whole or in part, to any third party, including by way of merger, acquisition, corporate reorganization, or sale of assets, upon prior notice to the Members of not less than thirty (30) calendar days.

The Member may not assign, transfer, delegate, sublicense or otherwise dispose of any of its rights or obligations under these Terms of Use without the prior express written consent of Bookerty, and any attempt to do so without such consent shall be null and void and of no effect.

Notices and communications

Unless specified otherwise, any notices or other communications to Members permitted or required under the Terms of Use will be provided electronically and given by Bookerty via email, Bookerty Platform notification, messaging service or any other contact method Bookerty enables you to provide.

You will receive administrative communications from Bookerty using the email address or other contact information you provide for your Bookerty account. Enrollment in additional email subscription programs will not affect the frequency of these administrative emails, though you should expect to receive additional emails specific to the program(s) to which you have subscribed. You may also receive promotional emails from Bookerty. No fee is charged for these promotional emails, but third-party data rates could apply. You can control whether you receive promotional emails using the notification preferences in your account settings. Please note that you will not be able to take advantage of certain promotions if you disable certain communication settings or do not have a Bookerty account.

Interpretation

These Terms of Use, together with any documents expressly incorporated by reference herein, constitute the entire agreement between you and Bookerty with respect to your access to and use of the Bookerty Platform and supersede any and all prior or contemporaneous oral or written understandings, communications, or agreements between the parties in relation to the subject matter hereof.

In the event that any provision of these Terms of Use is held to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remaining provisions, which shall remain in full force and effect, and the invalid, unlawful, or unenforceable provision shall be construed, to the maximum extent permitted by law, in a manner consistent with the original intent of the parties.

Terms of Use modifications

The Terms of Use may be modified at any time, in which case Bookerty will provide a 15 days’ notice before the date the revised terms of use become effective, via email or Bookerty Platform notification.

In case the modifications of the Terms of Use are material, Bookerty will request your explicit acceptance of the revised terms of use. In case you reject the revised terms of use, the agreement between you and Bookerty will be terminated immediately, while in case you do not respond to the relevant request within the set timeframe, the agreement between you and Bookerty will be terminated automatically on the prior date of the effective date of the revised terms of use, without any further notice. For the termination effects, please refer to the termination section.

In case the modifications of the Terms of Use are non-material or imposed by law, a legally binding court decision or a binding order of a competent authority, the use of the Bookerty Platform will be deemed as implied acceptance of the revised terms of use by you.

In any case, Bookerty suggests that you regularly refer to the Terms of Use, in order to keep informed of their current version.

All such communications shall be deemed received upon successful electronic transmission, unless a delivery failure notification is received by the sender.

Governing Law – Jurisdiction

Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the Hellenic Republic, without regard to its conflict of law provisions.

Dispute Resolution

The parties shall exert their best efforts to resolve amicably any dispute, controversy or claim arising out of or relating to these Terms of Use, including the interpretation, performance, breach or termination thereof.

For consumers residing within the European Union, Bookerty hereby informs that the European Commission provides a platform for Online Dispute Resolution, accessible at: https://ec.europa.eu/consumers/odr. Bookerty does not undertake any commitment and is not under any obligation to participate in alternative dispute resolution procedures as defined under Directive 2013/11/EU. The aforementioned platform is not available to residents of Switzerland or the United Kingdom.

Jurisdiction

Any dispute, claim or controversy arising directly or indirectly out of or in connection with these Terms of Use, or the access to or use of the Bookerty Platform, shall fall within the exclusive jurisdiction of the competent courts of Athens, Greece. Each party hereby irrevocably submits to the jurisdiction of said courts.
